Our primary means of communications these days seems to be text messaging – it is quick, to the point, and you don't have to listen to a bunch of bull crap. We can roll our eyes, shake our heads, look happy, be angry, disappointed or sad and the people on the other end of the text message have no idea how we feel without attaching a little emoticon. People all over the world text – it is not just a U.S. thing – there was a study in 2011 that shows that Canadians sent 78 billion text messages! This is an increase from 56.4 billion in 2010, or a 27.7% increase in a short two-year period and it shows no signs of slowing down.
When it comes to charging for these messages, there are very specific rules and regulations concerning full disclosure to the customer. The Honorable Marie-Anne Paquette of the Quebec Superior Court ruled that TELUS broke those rules and changed the terms and conditions of 177,425 TELUS customers, while on contract and without proper notification. It seems these customers in Quebec were charged 15 cents per incoming message. To reimburse the customers in this class-action suit against TELUS – for incoming text messages between 2008 -2011 – the Quebec court ruled that TELUS must pay more than $2.6 million, which should work out to about $15 per customer. In an email to our source, TELUS noted that:
"We openly communicated these changes well in advance of implementing them and offered our customers bundles with flat rates that included unlimited incoming texting. We are reviewing the Court's decision to determine our response and evaluate our options."
Our poor Canadian brethren already pay more for devices than we do in the U.S., additionally, in the past few months all the major carriers have 'adjusted' plans and raised prices. TELUS has also let their customers know that they will be shutting down their older CDMA networks by January 2017 and for thousands of subscribers this means their cellphones will become obsolete, forcing them to upgrade to a HSPA/LTE device.
